Conditions of Use

1. General Provisions

1.1. These Terms and Conditions govern the rights and obligations arising from the purchase contract concluded between the Seller, Mgr. Peter Kuscsik – EFROM, Company ID: 45505594 (hereinafter the “Seller”), and the Buyer (hereinafter the “Buyer”), through the Seller’s online store.

1.2. By placing an order, the Buyer confirms that they have read, understood, and agree to these Terms and Conditions.

1.3. These Terms form an integral part of every purchase contract. In case of conflict with a separately concluded written agreement, the written agreement shall prevail.

1.4. Product listings on the website are informational and do not constitute a binding offer. Availability is confirmed upon order processing.


2. Conclusion of the Contract

2.1. A purchase contract is concluded upon confirmation of the Buyer’s order by the Seller via e-mail or telephone after verification of product availability.

2.2. An automatic order confirmation does not constitute acceptance of the order.

2.3. The order confirmation includes essential details such as product description, price, delivery terms, and shipping costs.

2.4. The Buyer may cancel the order within 48 hours of submission by e-mail. Any payments already made will be refunded within 7 days unless otherwise agreed.


3. Seller’s Rights and Obligations

3.1. The Seller undertakes to:

  • deliver goods in accordance with the order,
  • ensure compliance with applicable legal requirements,
  • provide relevant documentation (invoice, warranty information where applicable).

3.2. The Seller reserves the right to cancel an order if goods are unavailable. In such case, the Buyer will be informed without undue delay and refunded within 15 days.


4. Buyer’s Rights and Obligations

4.1. The Buyer undertakes to:

  • accept the ordered goods,
  • pay the agreed purchase price and delivery costs,
  • provide accurate and truthful information necessary for order fulfilment.

5. Delivery Terms

5.1. Delivery is normally completed within 10 working days unless otherwise stated.

5.2. The Buyer is obliged to accept delivery at the agreed address.

5.3. The Buyer must inspect goods upon receipt and report any damage immediately to the carrier.


6. Payment Terms

6.1. Payment methods: bank transfer or cash on delivery.

6.2. The purchase price is considered paid when credited to the Seller’s bank account.


7. Transfer of Ownership and Risk

7.1. Ownership transfers to the Buyer upon full payment.

7.2. Risk of loss or damage transfers upon receipt of goods by the Buyer.


8. RIGHT OF WITHDRAWAL (EU CONSUMER LAW)

8.1. Consumers have the right to withdraw from the contract within 14 days without giving any reason, in accordance with Directive 2011/83/EU.

8.2. The withdrawal period begins on the day the Buyer (or a third party designated by the Buyer) receives the goods.

8.3. To exercise the right of withdrawal, the Buyer must notify the Seller via e-mail with a clear statement.

8.4. The Buyer must return the goods without undue delay, no later than 14 days after notifying withdrawal.

8.5. The Seller will refund all payments received, including standard delivery costs, within 14 days from receipt of the returned goods or proof of return.

8.6. The Buyer bears the direct cost of returning goods unless otherwise agreed.

8.7. The Buyer is liable for any diminished value of goods resulting from handling beyond what is necessary to establish their nature and functioning.


9. COMPLAINTS AND LIABILITY (WARRANTY)

9.1. The Seller is liable for defects existing at the time of delivery and for defects appearing during the statutory warranty period under applicable law.

9.2. Complaints shall be handled in accordance with applicable consumer protection legislation.

9.3. The Seller will confirm receipt of a complaint and inform the Buyer of the resolution within a reasonable period.


10. PERSONAL DATA PROTECTION (GDPR COMPLIANCE)

10.1. The Seller, as data controller under Regulation (EU) 2016/679 (GDPR), processes personal data solely for the purposes of contract performance, legal compliance, and legitimate business interests.

10.2. Categories of personal data processed
  • name and surname
  • billing and delivery address
  • e-mail address
  • telephone number
  • payment and order information
10.3. Purpose and legal basis of processing

Personal data are processed for:

  • performance of a contract (Art. 6(1)(b) GDPR),
  • compliance with legal obligations (Art. 6(1)(c) GDPR),
  • legitimate interests such as fraud prevention and business communication (Art. 6(1)(f) GDPR).
10.4. Data retention period

Personal data are stored:

  • for the duration of the contractual relationship, and
  • for up to 10 years thereafter, where required by accounting and tax laws, or
  • until withdrawal of consent where applicable.
10.5. Data sharing

Personal data may be shared only with:

  • shipping providers,
  • payment processors,
  • accounting and legal service providers,
    and only to the extent necessary.

Personal data are not sold or transferred to unauthorized third parties.

10.6. International transfers

If data are transferred outside the EU/EEA, the Seller ensures appropriate safeguards in accordance with GDPR (e.g., Standard Contractual Clauses).

10.7. Data subject rights

The Buyer has the right to:

  • access their personal data,
  • rectify inaccurate data,
  • erase data (“right to be forgotten”),
  • restrict processing,
  • data portability,
  • object to processing,
  • lodge a complaint with a supervisory authority (e.g., Slovak Data Protection Authority).

11. COOKIES POLICY

11.1. The website uses cookies necessary for its operation and analytics.

11.2. Cookies used include:

12. FINAL PROVISIONS

12.1. The Seller reserves the right to amend these Terms and Conditions.

12.2. Changes become effective upon publication on the website.

12.3. Legal relations are governed by Slovak law and applicable EU consumer protection law.

12.4. If any provision is found invalid, the remaining provisions remain in force.

12.5. By placing an order, the Buyer confirms acceptance of these Terms and Conditions.
